JD Sports fined nearly £70,000 after escape routes reduced to 30cm

Sportswear giant JD Sports has been fined almost £70,000 in costs after breaching fire regulations after firefighters found that piles of stock ordered for the Christmas rush had blocked emergency exits at one of its Black Country stores. West Midlands Fire Service found that escape routes at the JD Sports shop in the Merry Hill shopping centre in Brierley Hill was lined with crates and stock, reducing the width of one corridor to just 30cm. Wolverhampton Magistrates Court heard that inspectors visited the store in December 2015 as part of routine pre-Christmas programme of visits.  JD Sports admitted six offences at a hearing before a district judge in Wolverhampton on … Read More

10yrs Since the Corporate Manslaughter and Corporate Homicide Act Gained Royal Assent

Despite 25 convictions under the Corporate Manslaughter and Corporate Homicide Act since it received royal assent ten years ago, none have been given to a large organisation. The Corporate Manslaughter and Corporate Homicide Act, which came into force on 6 April 2008, clarifies the criminal liabilities of companies including large organisations where serious failures in the management of health and safety result in a fatality.  Prosecutions will be of the corporate body and not individuals, but the liability of directors, board members or other individuals under health and safety law or general criminal law, will be unaffected. The corporate body itself and individuals can still be prosecuted for separate health and safety offences. … Read More

HSE: fatal injury rate hits lowest on record but decline flatlines

The health and safety sector have welcomed a slight fall in the number of people who died in workplace accidents in 2016-17 compared to the year before, but unions have argued that the era of deregulation must end for the numbers to significantly fall in coming years. Provisional figures released by the HSE on 5 July show that 137 workers were fatally injured in the year to the end of March 2017, compared to 147 in the preceding year, and 142 in 2014–15. This is the second lowest annual number of fatal injuries on record: the lowest toll came in 2013–14, when 136 workers died. Looking at the overall downward … Read More

Let’s fly the flag for life-saving health & safety law!

The 40yr old Act’s rules are founded on common sense, but they’ve been hijacked by jobsworth! Summer is well under way, so we can expect the usual litany of patronising health and safety announcements on public transport and elsewhere. Among the blindingly obvious bits of advice that have apparently passed mankind by in the millennia since we started to walk upright are the following: we should wear loose-fitting clothes in the heat, make sure we drink plenty of water and sit down if we feel faint. At Lord’s of all places, the players during the England v Sri Lanka Test stopped not for drinks, which have sustained cricketers since the … Read More
